The LegalCORPS Inventor Assistance Program continues to enjoy attention in the press as it reaches the midway point of its second year.

La junta de directores LegalCORPS ha adoptado una resolución que se opone tanto a Minnesota State cuestiones constitucionales electorales los votantes decidirán noviembre 6 – on the grounds that constitutional amendment is not the appropriate legislative method for the issues that either of the questions addresses.

The LegalCORPS board concluded that both state constitutional amendment questions would have a material impact on participants in LegalCORPS programs, so it is appropriate for the organization to take a public stand on the questions. The LegalCORPS board is releasing this statement:

The members of the LegalCORPS Board of Directors firmly believe that the issues posed by two proposed state constitutional amendments to be voted upon in November 2012 have a material impact on LegalCORPS program participants.

Topics of civil marriage rights and duties, including those relating to property rights, to inheritance of business assets, to employment benefits, and to other issues affecting the operation of enterprises have a material impact on business decisions of microenterprises and small nonprofits served by LegalCORPS’s volunteer attorneys.
Restrictions placed on citizens’ participation in elections to choose representatives who regulate the conduct of small businesses and nonprofits have a material impact on those served by LegalCORPS volunteer attorneys.

The LegalCORPS Board of Directors has adopted a resolution opposing the use of the constitutional amendment process to address these issues because:

Minnesota’s state constitution is not an appropriate place to legislate procedures for exercising voting rights or regulations governing civil marriages.
A constitution requires extraordinary measures to amend, so constitutional amendments – especially when proposed without a broad consensus – hinder or thwart the normal legislative process in responding to changing needs of and beliefs of the majority of citizens.
It usurps the proper role of the legislative and executive branches in the republican form of government in developing statutory law.
